You should read the following terms, conditions, and declarations carefully before using the website's electronic system. By using the website, you confirm your acceptance of these terms, conditions, and declarations, and your agreement to comply with the provisions contained therein. In these terms and conditions, the National Center for Palms and Dates will be referred to as the “Center” and the website user will be referred to as the “User”. The following is a statement of the declarations, terms, and conditions:
- User Declarations:
- The “User” affirms its understanding and compliance with all terms and conditions as per the laws and regulations of the Kingdom of Saudi Arabia, especially those concerning agricultural and marketing services and the like.
- The “User” takes full responsibility for the accuracy of all information it provide or upload to the system. This includes, but is not limited to, digital entries and uploaded documents, which the “User” must verify and keep current. Therefore, the “User” confirms that all provided information is accurate and up-to-date, committing to update it whenever changes occur.
- The “User” understands that any breach of these terms and conditions, or providing fraudulent or forged documents or inaccurate information will result in legal consequences.
- The “User” accepts full responsibility for its own account on the website, ensuring that it is the sole user of the account. Consequently, all account activities are legally binding on the beneficiary as the account holder.
- The “User” recognizes that the Center has the right to verify the authenticity of the documents uploaded to the system by the User, and the Center has the right to reject any incomplete, inaccurate, or fraudulent requests. The Center may also delay processing requests for further evaluation or technical issues and reserves the right to accept, reject, or cancel any requests or contracts without prior notice.
- The “User” acknowledges that the Center is not liable for any financial or legal losses incurred due to errors in the services provided through the website. It is the “User's” responsibility to report errors by submitting an electronic support ticket via the (Contact Us) icon or by emailing info@ncpd.gov.sa. The Center or its representative will take appropriate action and inform the “User.”
- The “User” consents to the “Center” or its representative verifying any provided information to approve or reject the requests of the “User”, manage the “User's” account, or perform other necessary procedures using data from any government or other entities.
- In the event of a conflict between the terms and conditions of any site affiliated with the National Center for Palms and Dates and the terms outlined in the User Policy of the National Center for Palms and Dates website, the terms and conditions of the affiliated site will prevail and be considered authoritative.
- Terms of Use
By using the portal, the User is deemed to have read and agreed to the following terms and conditions:
- Provide and enter complete, clear, and accurate data and information.
- Comply with all relevant laws and regulations of the Kingdom of Saudi Arabia and obtain all necessary licenses.
- Adhere to all requirements of government entites in the Kingdom of Saudi Arabia, including but not limited to the requirements of the National Center for Palms and Dates (“Center”).
- Access to the Website:
- The “Center” does not guarantee the continuity or availability of the system or any part of its content. The Center reserves the right to suspend, block, stop, or change all or part of the system without prior notice to the “User”. Furthermore, the “Center” disclaims any responsibility for the unavailability of the system for any reason and at any time.
- The “User” is responsible for all access procedures necessary for using the platform.
- The system is designed for use within the Kingdom of Saudi Arabia. The “Center” does not guarantee the availability of system content outside the Kingdom. The Center also reserves the right to limit the provision of the system and regulate its services for any beneficiary at any time. The “User” assumes full responsibility for accessing the system from outside the Kingdom.
- Limitations of Liability
- These terms, conditions, and declarations do not include anything that can be interpreted as holding the “Center” responsible for death or personal injury arising from the “User's” negligence, or fraud or misrepresentation in fraudulent ways by the “User.”
- The “Center” shall not bear any responsibility or legal consequences towards any beneficiary for any loss or damage, whether contractual or tort liability, including negligence, or breach of legal duty, or otherwise, even if foreseeable, arising under or in connection with the following: Use, or inability to use, the system and/or; Use or reliance on any content displayed on the system.
- The “Center” shall not bear any responsibility for any loss or damage caused by a virus, unauthorized entry to the platform, or other technically harmful material that may infect the customer's devices, software, data, or other materials as a result of their use of the platform or as a result of the “User” downloading any content from the system or from any other site linked to the system.
- The “Center” shall not bear any responsibility for the content of other sites linked to the portal. Such links should not be interpreted as endorsed by the “Center,” and therefore the “Center” shall not bear any responsibility for any loss or damage that may arise from the “User's” use of those links or the portal.
- The “Center” does not make any statements, representations, warranties, or recommendations to any beneficiary of the system in respect of any arrangement between them and another beneficiary of the system. The “Center” shall not be considered a partner or guarantor of the developer or responsible for it in any legal manner towards the “User” for any act or omission or transaction between the parties dealing through the system.
- Ownership of personal information relating to the “User,” and any other information and data provided on the system when creating the account, shall be available for the benefit of the “Center” free of charge. The “Center” shall have the full right to use it for statistical purposes, research, and development.
- The “User” is solely responsible for all ideas, opinions, and personal data it mention while using the services on the website, as well as all files uploaded to the system and the personal information sent. The system will not be responsible in any way for those files or for accessing any services provided through the system unauthorized or in any way other than specified by the system. The “User” must not alter the software in any way.
- The “User” bears full responsibility for all material and moral damages in case of non-compliance with the aforementioned terms and conditions. The “Center” shall not be responsible for any damages that may arise from unauthorized persons reading the data of any beneficiaries.
- The “User” undertakes not to send any messages that are threatening, immoral, racist, or contrary to the laws of the Kingdom of Saudi Arabia and international agreements. The “User” undertakes not to harass or threaten other users or any of the Center's customer service employees, and not to act in a way that affects the use of the services by other users. The “User” must not send, print, distribute, or circulate any immoral, inappropriate, or illegal materials or information that may harm the names of any persons or institutions. The “User” must not advertise, sell, or offer for sale any products or services, participate in harmful acts such as surveys, competitions, or chain letters, or send any information or programs that may damage the information or software on other users' devices.
- Intellectual Property and Trademarks
The National Center for Palms and Dates website and its logos are trademarks owned by the Center. All intellectual property or trademarks not owned by the Center that appear on the portal are the property of their respective owners. The beneficiary may not use any of these trademarks or any of their forms for promotional purposes, or imply a relationship with the owner of the relevant trademark, either intentionally or unintentionally. The system does not include anything that can be interpreted as granting - whether expressly, implicitly or otherwise - any license or right to use any of the trademarks displayed on the system without the written permission of the owner of the relevant trademark.
- Prohibited Uses
The beneficiary may use the website only for legitimate purposes and must not use the system for any of the following, including but not limited to:
- In any manner that violates local, national, or international laws and regulations.
- In any illegal or fraudulent manner or for any illegal or fraudulent purpose or effect.
- To harm or attempt to harm others in any way.
- Intentionally sending, receiving, uploading, downloading, using, or reusing any material that does not comply with the Center's approved content standards as set out below - including but not limited to:
- Transmitting or commissioning unsolicited or unauthorized advertisements or promotional materials or any form of spam.
- Transmitting any data, sending, or uploading any materials containing viruses, Trojan horses, spyware, or other malicious programs or computer code designed to adversely affect the operation of any system-related programs or devices.
- Changes or Modifications to These Terms
These terms, conditions, and declarations, in addition to any additional terms applicable to the “User's” use of the site, are subject to ongoing updates and changes as needed. The Center reserves the right to prevent the “User” from using the system unless they agree to any amendments or changes made to the terms and conditions. Any amendment or update to these terms and conditions will become effective upon its adoption by the “Center” and notification to the “User” through the system. The “User” is responsible for continuously reviewing these terms and conditions, as well as the Center's and its affiliates' limitations of liability, to stay informed of any updates. Continued use of the system signifies the “User's” awareness and acceptance of any changes made to the terms of use.
- Suspension and Termination
The “Center” shall determine, at its discretion, whether there is a breach of the Terms of Use by the “User's” use of the website. If it is found that there has been a breach of these terms and conditions, the “Center” may take such action as it deems appropriate. Failure to comply with these terms, conditions, and declarations, or in the event of fraud or forgery by the “User,” may result in all or any of the following actions, including but not limited to:
- Issuing a warning to the beneficiary.
- Immediate, temporary, or permanent withdrawal of the “User's” right to use the system.
- Immediate, temporary, or permanent removal of any documents or materials that the “User” has uploaded to the system.
- Taking legal action against the “User” to claim compensation for all costs (including, but not limited to, administrative and legal costs) resulting from the breach of the terms and conditions.
- Taking further legal action against the “User.”
- Applicable Laws and Regulations
These terms, conditions, and declarations, and their subject matter and form, are subject to the laws and regulations in force in the Kingdom of Saudi Arabia. If any provision of these terms and conditions is deemed void, invalid, or unenforceable under the laws and regulations in force in the Kingdom of Saudi Arabia, it shall not affect the validity and enforceability of the remaining terms and conditions on the “Users” of the platform. The courts of the Kingdom of Saudi Arabia shall have exclusive jurisdiction in this regard.
- Communications and Comments
- Beneficiaries can contact customer service regarding any matter related to the system or services, including but not limited to general inquiries, suggestions, claims, or disputes, by reaching out to the customer service center at the following email address: info@ncpd.gov.sa. Notices submitted to customer service are not considered received unless the “User” receives an electronic notification confirming receipt.
- All notices and notifications related to the website will be sent to the address registered in the “User's” account in the system. Notification in this manner shall be considered official, whether electronic, and shall be effective from the date of dispatch.
- The “User” shall inform the “Center” of any change or modification to its address or information.
- Personal Data Protection Policy
Understanding the importance of the data and data confidentiality and the “Center” commitment to providing the highest levels of service, while adhering to the safeguarding the confidentiality and privacy of user data and entered data, the system management is dedicated to safeguarding the confidentiality and privacy of the information users and data entered them as a basis for the privacy policy. This privacy policy outlines how the Center collect, use, preserve, and disclose user data, in compliance with the Personal Data Protection System. Below are the key provisions for personal data protection:
1. Scope: This policy applies to any processing of personal data related to “Users” within the Kingdom, regardless of the method. The following are exempt from the scope of this policy:
- If a public authority requests disclosure for public interest, security, legal, or judicial purposes, or to implement another system or to meet judicial requirements.
- If disclosure is necessary for public health, safety, or to protect the life of an individual or individuals or to protect their health.
- If the disclosure will be limited to subsequent processing in a manner that does not identify the data subject or any other individual.
- If disclosure is essential for the legitimate interests of a regulatory authority, provided it does not infringe on the data subject's rights or conflicts with their interests and involve sensitive data.
2. Purpose of Collecting Personal Data: The Center collects personal data to measure user satisfaction with the services of the system periodically. This helps us understand user needs, analyze their interactions with other parties using our system, and evaluate the ease and satisfaction of users with the services provided by the system.
3. Personal Data Collected
Various types of personal data are collected, including: full name, nationality, city, gender, ID number, mobile phone number, organization name, service provided, service details, and service period.
4. Key Principles for Personal Data Protection
- Introduction
Consumer's personal data that is required to be protected includes any statement - whatever its source or form - that leads to the identification of the consumer's identity, such as: name, identification data, address, contact numbers, license numbers, records and personal property, account numbers and bank cards, still and moving images. Service providers are also required to:
a. Protect consumers' personal data from unauthorized access, disclosure, alteration, or processing, by applying technical and administrative measures commensurate with the nature of such data.
b. Retain consumers' personal data only to fulfill the service provider's obligations, prohibiting its use for any other purposes, such as advertising or marketing, without the consumer's prior express consent.

The privacy policies and procedures of the controller must be identified, documented, approved by the top official of the entity, and communicated to all relevant parties for implementation.

- Principle 7: Data Disclosure Limitation:
The disclosure of personal data to third parties should be restricted to the purposes specified in the privacy notice, for which the data subject has given their implicit or explicit consent.

Establishment data will also be shared with government entities for legitimate purposes based on a systemic basis or justified work need aimed at achieving a public interest without causing any harm to national interests, activities of the entities or the privacy of individuals or environmental safety - with the exception of data and entities exempted by royal orders.

Your personal data is securely stored and processed within the Kingdom's geographical boundaries to maintain the digital sovereignty of this information. All servers containing your personal data are protected according to the guidelines issued by the National Cybersecurity Authority.
- Access to your information is restricted to “Center” employees who need to access and use it. Before using or processing this data, its necessity and alignment with the purpose for which it was collected are carefully evaluated.
- When necessary, your personal data will be shared with government entities for the purposes specified in the section (Why do we collect and use your personal data?)—with the exception of entities exempted by royal orders. If the “Center” or a government entity intends to use your personal data for purposes beyond those specified, your prior consent will be obtained.
- Before sharing your personal data with any government entity, the intended purpose will be identified and studied, and a non-disclosure agreement will be signed. This agreement will ensure that records are kept regarding how your personal data is processed and used, ensuring it is utilized solely for the agreed-upon purpose. Secure technologies will be employed to ensure your data is transferred securely to the other government entity.
